All Members and other users of this site agree that they have read and fully understand these terms and conditions and agree to be bound thereby.

Contractorhotdeals.com provides a means for members to list items for sale through online advertisement and for potential buyers to inquire for its purchase. While Contractorhotdeals.com provides a media for the placement of advertisements for sale of surplus contractor items, Contractorhotdeals.com is not a party to the actual sale and has no control over the listed information or the ability of a member and purchaser to complete a transaction.

Contractorhotdeals.com reserves the right to make changes to the following terms and conditions as is deemed necessary without notice to members.

1. Contractorhotdeals.com provides an advertisement service only and shall not be responsible for the following;

any misrepresentation of product/service or accuracy of advertisement.
non-delivery of product or service advertised
non-receipt of payment from the buyer of products advertised
any shipping cost related to the buying or selling of products advertised
any shipping mishaps including overcharging, damage, late shipments
any negotiations between the Buyer and the Seller
any product warranty
non-sale of any product or service advertised on this site
any sales tax or other related to the selling or purch ase of products or services
the installation of any product purchased through this web site including, but not limited to, the adherence to all applicable federal, state and local laws regarding the proper installation of any products advertised on this web site

2. Members agree to only post advertisements to Contractorhotdeals.com website that the Member has the legal right to sell or dispose of. Any information posted will be accurate to the best of the Members knowledge and all property offered for sale shall conform to its description. Members shall not post false, inaccurate, misleading, defamatory, or libelous content (including personal information). Further, Members shall not post advertisements containing anything of a pornographic or objectionable nature, including the use of obscene language, nor posting advertisements for illegal activities, products, or services. Further, Members shall not use this site in any way to promote or aid in illegal activities.

3. Members shall not engage in keyword spamming whereby a member uses brand names or other inappropriate keywords in a title or description unrelated to the actual item for the purpose of diverting potential purchasers to a listing. Members shall ensure that searchable text reflecting their listing must be directly relevant to the item being sold. Additionally, Members agree to only use links to digital pictures of associated assets, and will not create links to any other site, text or other information without the prior written consent of Contractorhotdeals.com. Further, Members shall not distribute or post spam, chain letters or pyramid schemes.

4. Member grants to Contractorhotdeals.com a non-exclusive, non-transferable, irrevocable, and royalty-free right to exercise any copyright or publicity rights a Member may have in the information it posts to the Contractorhotdeals.com server. Contractorhotdeals.com agrees to use this information only for its intended purpose.

5. Member will not use any programs, routines, or applications in connection with Contractorhotdeals.com that will interfere with the operation of the software or site. Specifically the Member will only communicate with Contractorhotdeals.com server by using software and applications that Contractorhotdeals.com provides or specifically approves in writing.

6. Members acknowledge that the proprietary internet advertisement system, environment, and components provided by Contractorhotdeals.com are and will remain the exclusive property of Contractorhotdeals.com. Contractorhotdeals.com retains and reserves all rights to the proprietary intellectual property of the system. Contractorhotdeals.com is providing the Member hereunder with a license for said system solely for its own use. Members shall not subcontract, sell, lease, transfer, assign or otherwise share said system with any third party.

7. Members certify that they are at least 18 years of age and have the legal right to become a Member. Members further certify that any and all information provided by the Member in the Membership Registration is correct.

8. Contractorhotdeals.com does not warrant error-free or uninterrupted use of the Contractorhotdeals.com service. The Contractorhotdeals.com web site, services, software and applications are provided without warranty, express or implied, including but not limited to, any implied warranties for merchantability or fitness for a particular purpose. Contractorhotdeals.com, its officers, employees and agents and or affiliates shall not be liable for any loss of profit and or any direct, indirect, special, incidental or consequential damages resulting from the services offered herein.

9. Contractorhotdeals.com is not responsible for missed deadlines, closing dates, or insertions caused by delay of approving the advertisement to be used.

10. Contractorhotdeals.com reserves the right to censor, reject, alter, or refuse any and all advertisements in its sole discretion or disapprove any advertisement in accordance with any rules that Contractorhotdeals.com may have now, or may adopt in the future, concerning acceptance of advertisements, but no change in the advertisement will be made without the prior consent of the Member.

11. The Member assumes full and complete responsibility and liability for the content of all advertising copy submitted and presented on the Contractorhotdeals.com web site. Member shall indemnify and hold Contractorhotdeals.com, its officers, employees, and agents and or affiliates harmless from and against any and all claims, liabilities, or damages arising from the preparation or presentation of advertisement posted to the Contractorhotdeals.com web site, including cost of litigation and legal fees. The Member shall reimburse Contractorhotdeals.com, its officers, employees, and agents and or affiliates for any amounts paid in settlement of claims or in satisfaction of judgments obtained by reason of publication of such advertising. Additionally, Members acknowledge that Contractrohotdeals.com is not involved in the actual transaction between buyers and sellers. Contractorhotdeals.com has no control over and does not guarantee the quality, safety or legality of items advertised, the truth or accuracy of listings, the ability of sellers to sell items, the ability of buyers to pay for items, or that a buyer and seller will actually complete a transaction. Further, Contractorhotdeals.com shall not be liable for any loss of money, goodwill, or reputation, or any special, indirect or consequential damages arising out of your use of this Site. Regardless of the preceding, if Contractorhotdeals.com is found to be liable, its liability, and the liability of its officers, employees, and agents and or affiliates, shall be limited to the greater of (a) the total fees you paid to us in the 12 months prior to the action giving rise to the liability, or (b) One Hundred and 00/100 Dollars ($100.00).

12. Contractorhotdeals.com reserves the right to suspend or cancel membership at any time for Members not following the Membership Terms of Use. Contractorhotdeals.com will provide written notification by email to the Member’s email address provided in the membership registration of any suspension or cancellation of membership.

13. Members who have a dispute with one or more users agree to release Contractorhotdeals.com, its officers, employees, and agents and or affiliates harmless from and against any and all claims, liabilities, or damages (actual or consequential) of every kind and nature, known or unknown, arising out of or in any way connected with such disputes.

14. We do not sell or rent your personal information to third parties for their marketing purposes without your express consent. We may use your information only in accordance with our company’s Online Privacy Statement. We view protection of users' privacy as a very important community principle. You can access and modify the information you provide us and choose not to receive certain communications by signing-in to your account. If you object to your Information being transferred or used in this way please do not use our services.

15. Any controversy or claim arising out of or relating to the use of Contractorhotdeals.com web site shall be settled by arbitration, in accordance with the rules of the American Arbitration Association, in Lima, Allen County, Ohio and judgment upon the award rendered by the arbitrator or arbitrators may be entered in any court of competent jurisdiction.
